Heard the learned Counsel appointed for the applicant and the learned APP. The learned APP upon instructions submits that the prosecution has examined almost all witnesses and the investigating officer has to enter into the witness box. The trial was already expedited by an order dated 7/1/2014 by the Coordinate bench (Coram : A.R. Joshi, J).

19.ba391.15.sxw The learned Counsel appointed for the applicant submits that the applicant has been in jail for more than 3 years and that justice delayed would be justice denied. He has placed reliance upon the Judgment of the Hon'ble Apex Court in the case of Hussainara Khatoon vs. Home Secretary, State of Bihar reported in 1979 AIR 1369 and submits that it is the fundamental right of the accused to have an expeditious trial. However, no orders are necessary at present. Hence, the application is disposed of accordingly. The learned Counsel appointed has put in best of the efforts to espouse the cause of the applicant. The professional fees is quantified at Rs. 1,000/- to be paid to the learned Counsel within 3 months from today.
