At the outset, learned APP submits that till date, four witnesses are examined and 5 witnesses are yet to be examined. Since the trial has commenced, the learned counsel for the Applicant does not press this Application and seeks leave to withdraw this Application.

Accordingly, the Application is disposed of as withdrawn.

Since the trial has commenced, it is expected that the learned trial Judge shall decide the case as expeditiously as possible and preferably before September, 2016, more particularly, the Applicant is languishing in jail since 2012.

Registry to communicate the aforesaid order to the learned Ad-hoc District Judge-1 and Additional Sessions Judge, Pandharpur, DistrictSolapur, who is seized of the Sessions Case No.3 of 2013. Learned counsel for the Applicant shall also produce a copy of the said order before the learned Sessions Judge, who is seized of the case.
