This petition is listed in the backdrop of the fact that the learned Arbitrator appointed by an order dated 03rd January, 2023 has recused from the matter. The learned Arbitrator was appointed on the joint request by the parties.

In this earlier, learned Counsel for the parties make a joint request for appointment of an Advocate Shanay Shah, as a substitute Arbitrator.

In view of the commercial expression on behalf of the parties, Advocate Shanay Shah is appointed as a sole Arbitrator. The details of the learned Arbitrator are as follows : Mr. Shanay Shah, Chambers of Rohaan Cama, Islam Building, 1st Floor, 461, V. N. Road, Shrikant

The learned Arbitrator shall communicate his consent and Disclosure Statement under Section 11(8) r/w 12(1) of the aforesaid Act, within a period of four weeks to the Registrar (Judicial) of this Court.

The Fees of the learned Arbitrator shall be as per Schedule IV to the aforesaid Act.

6.

The rest of the contents of the order dated 03rd January, 2023, shall continue to operate.

7.

It is recorded that the parties have agreed for the place of Arbitration shall be Mumbai.
