Learned Counsel appearing for the Petitioner fairly submitted that though the Petitioner was aggrieved by the order of the learned Judge of the Labour Court, Ratnagiri dated 15 September 2012, thereby permitting the Respondent Corporation to impose any other punishment than the punishment of dismissal, and though this order was maintained by the Revisional Court subsequent to filing of the petition, the Respondent Corporation passed the order dated 6 May 2017. By order dated 6 May 2017, the punishment is awarded to the Petitioner of bringing down his basic pay scale permanently by three stages. Learned Counsel for the Petitioner submits that the Petitioner is desirous of challenging the punishment imposed subsequent to the order passed by Pg 1 of 2

wp5493-17.doc the learned Judge of the Revisional Court. The present petition be permitted to be withdrawn with liberty to challenge the order dated 6 May 2017 of the Divisional Traffic Officer, Maharashtra State Road Corporation, Ratnagiri. In view of the submission, the Petitioner is permitted to withdraw the petition with liberty as prayed for. Needless to state that any proceeding initiated by the Petitioner challenging the order of the Divisional Traffic Officer, Maharashtra State Road Corporation, Ratnagiri would be considered on its own merits.
