DATED : 21st JUNE, 2022 P.C:- By the present application, the applicant seek permission to travel to South Africa for eight weeks. His itinerary is placed on record, which disclose that he intend to travel on 25/6/2022 from Mumbai to Doha and thereafter, by Qatar Airways he is to proceed to Johannesburg (South Africa). As per his itinerary, he is scheduled to return on 17/8/2022 by Qatar Airways.

The applicant was conferred with protection from arrest in C.R.No. 95/2017. On 24/11/2017 and as a condition of his release, he was directed to deposit his passport with the Investigating Officer. By an order passed by this Court, his passport was returned to him.

2/2 10 IA 836-22.doc He now seek permission to travel to South Africa since he has already obtained visa. The learned APP state that the applicant is accused by a serious offence punishable u/s.465, 467, 468, 471, 419, 420 read with Section 120B of the IPC, and he stated that the trial is due. When specifically asked, the learned APP concede that the charge is framed and the dates are being fixed, but till date, no witness summons are served. The learned APP also make a statement that the next date in the JMFC, 38th Court, Ballard Pier, is 22/6/2022. The applicant shall mark his attendance before the learned Magistrate tomorrow and apprise him of the permission granted by this Court to travel abroad.

The applicant shall strictly abide by the itinerary, which he has placed on record and report back to the country on the scheduled date. During the period when he is permitted to travel, his place of residence shall be Johannesburg (South Africa), and in case of any change in the plan, he shall keep the Investigating Officer update.

Upon his return, the applicant shall surrender his passport.
