By this application, the applicant seeks relaxation of the condition imposed by this Court vide order dated 6th May, 2014 passed in Criminal Application No. 205 of 2014.

While releasing the applicant on bail, this Court has imposed a condition that the applicant shall attend the office of Investigating Agency on every Sunday between 10:00 to 12:00 noon, till the conclusion of the trial. The present application is filed for relaxation of the said condition only.

Learned Counsel for the applicant submits that, the charge-sheet is already filed in the matter. The applicant is an Officer working with the Thane Municipal Corporation. There is no likelihood of the applicant to abscond so as to avoid trial. The learned Counsel further submits that, in the connected matters arising out of the same crime, the similar request made by the applicant therein, was granted by this Court on 13th March, 2015, and the condition of attendance was modified as under :
"The applicant shall attend Crime Branch Unit I, Thane on first Monday of each month between 11:00 a.m. to 1:00 p.m. till conclusion of the trial."

Learned APP for the State submits that, in view of order passed in connected matters, she has no objection to modify the said condition of attendance of the applicant.

In view of above, the application is allowed. The condition imposed upon the applicant to attend the office of Investigating Agency on every Sunday between 10:00 to 12:00 noon, till the conclusion of the trial, is modified as under:
"The applicant shall attend Crime Branch Unit I, Thane on first
Monday of each month between 11:00 a.m. to 1:00 p.m. till conclusion of the trial."
With the above directions, present application is disposed of.
