The Petitioner is the accused in the criminal case registered for the offences punishable under sections 279, 338 read with 34 of the Indian Penal Code. The learned counsel appearing for the Petitioner submits that after the accident took place, the petitioner accused did not run away but accompanied the injured to the hospital. Unfortunately the injured succumbed to the injuries and died.

Ms. Viteja N. Shah, who is the daughter of the deceased, has filed the affidavit. Learned counsel appearing for her submits that the Respondent No.1 has no objection if the Borey 1/2

spb/ 908wp732-16.doc proceedings are quashed. Both the Petitioner and Respondent No.1 are present in the court.

Learned APP on behalf of the State, at this stage, submits that the investigation would be practically completed within two weeks and appropriate report would be filed in the court.

In the facts of the case, we are of the view that the State be allowed to file final report.

Keeping all issues and rights of the parties open, the Petition is disposed of.
