The cause for moving the above Writ Petition is the fact that the Petitioner's Appeal and the stay application therein is not being taken up for consideration as the Appellate Authority i.e. Principal Secretary, Home Department, Mantralaya, Mumbai is not available. The said Appeal has been filed against the order dated 06.01.2017 passed by the Licensing Authority i.e. Collector, Solapur cancelling the Petitioner's premises licence, performance licence and ticket selling licence in respect of the Petitioner's establishment known as Hotel Galaxy and Orchestra Bar at Kondi, Taluka South Solapur. The Learned AGP Mr. S. H. Kankal on instructions makes a statement that the Appeal filed by the Petitioner would be disposed of within six weeks of date. In view thereof, there would be stay of the cancellation of the Petitioner's licences during the BGP.

pendency of the Appeal before the Appellate Authority. The Appellate Authority is directed to hear and decide the Appeal on or before 05.04.2017. Needless to state that the contentions of the Petitioner are kept open for being urged before the Appellate Authority. The Appellate Authority to decide the Appeal on its own merits and in accordance with law. In the event the order is adverse to the Petitioner, the same not to be given effect to for a period of two weeks from the receipt of the same. With the aforesaid directions, the Writ Petition is disposed of. [R.M.SAVANT, J] BGP.
