1) By the present application the applicant is seeking modification of an order dated 23.7.2014 passed by this Court in Bail Application No.1007/2014.
2) The applicant was ordered to be released on bail on certain conditions. Apart from the other conditions, the applicant was also directed to report to the Trial Court on every Monday, till the conclusion of trial. The learned counsel for the applicant submitted that in the case of co-accused, this Court has already modified the similar condition by an order dated 11.1.2016 passed in Cr. Appln. No.1067/2015 He further submitted that the applicant till date has regularly complied with the conditions imposed upon him by an order dated 23.7.2014. In view of the same, I am inclined to modify the condition imposed upon the applicant.

ORDER:
a) The condition that the applicant to report to the Trial Court on every Monday is hereby modified and the applicant is directed to attend the Trial Court on every 1st and 3rd Monday between 11:00 a.m. to 1:00 p.m. till conclusion of the trial. It is made clear that rest of the conditions imposed upon the applicant by an order dated 23.7.2014 are not disturbed;
b) Any two consecutive defaults at the behest of the applicant in complying with the aforesaid condition will attract the provisions of Section 439 of Criminal Procedure Code;
c) The application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
