The learned counsel for the Appellants states that the heirs have not contacted the Advocate for considerable time and according to her instructions, the same is the position with the Respondents. 2.

It appears that by the Judgment and Order passed by the District Court, the suit of the Appellants-Plaintiffs has been

The appeal is accordingly dismissed for non prosecution. If the parties are desirous in prosecuting the appeal, they can make an application for restoration of the appeal, but within a reasonable period. (N.M.Jamdar, J.)
