Heard learned counsel for the applicant and learned APP for the State.

The applicant was arrested on August 14, 2020 for the offence punishable under Sections 363, 376 read with 34 of the Indian Penal Code, 1860 read with Sections 6, 8 and 12 of the Protection of Children from Sexual Offences Act, 2012. The applicant is in custody for more than two years and six months. There are no criminal antecedents reported against the applicant. The regular bail application filed by the applicant has been withdrawn on February 14, 2023. 1/2

Diksha Rane 24. IA 619-23.doc The applicant contends that the applicant's real brother is getting married on February 23, 2023. The factum of the applicant's real brother marriage has been verified by the investigating ofocer.

The victim is residing at Vile Parle. The applicant is a resident of Mira-Bhayander and even the marriage is scheduled at Mira-Bhayander.

Taking an over all view of the matter, the applicant can be released on temporary bail for a period of two weeks from the date of his release. Hence the following order.

O R D E R

(a) The application is allowed.

(b) The applicant-Ulhas Chandrakant Shendge in connection with FIR No.357/2020 with Vile Parle Police Station, shall be released on temporary bail on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant is permitted to furnish temporary cash bail surety in the sum of Rs. 15,000/- for a period of 2 weeks in lieu of surety.

(d) The applicant shall surrender within two weeks from the date of his release.

The Interim Application is also disposed of.
