Heard the learned counsel for the applicant and the learned APP for the State.

The learned counsel for the applicant submits that having regard to the nature of the case, the applicant may be permitted to withdraw the application with a direction to the Court of Session to conclude the trial within a reasonable period. The learned counsel seeks liberty to move for bail, in the event the trial is not completed within the time which may be stipulated by this Curt. 3.
I have perused the report under section 173 of the Code of Criminal Procedure and the documents annexed with it. 4.

In the backdrop of the aforesaid peculiar circumstances, I deem it appropriate to request the learned Sessions Judge to make an endevour to complete the trial as expeditiously as possible and preferably within a period of eight months from the date of communication of this order.

The application stands disposed as withdrawn with liberty to the applicant to apply for bail in the event the trial is not completed within the said period of eight months.

This Court has not entered into the merits of the matter and the learned Sessions Jude shall decide the case uninfluenced by any of the observations made hereinabove.
