Heard. This Application is preferred by wife for staying the operation and implantation of the impugned order dated 9th December, 2016 passed by the learned Judge Family Court, Pune in Petition No.A974 of 2012. By that order, the Family Court directed the Applicant to reimburse the amount of interim maintenance received by her from the Respondent on the basis of interim maintenance order passed by the trial court.

11.cam.45.17.doc This Court, by order dated 26th April, 2017 stayed the order during the pendency of the appeal.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Civil Application, we are satisfied that the Applicant has made out the case for continuing the order dated 26th April, 2017 till the hearing and final disposal of the appeal. Hence the following order.

a) The order dated 26th April, 2017 passed by this Court (Coram V. M. Kanade and C. V. Bhadang,JJ) to continue till the hearing and final disposal of Family Court Appeal.
