Heard Mr. Shah, learned Counsel for the petitioner and Ms. Sharma, learned Counsel for the respondent at length. 2.

By this Petition under Article 227 of the Construction of India, the petitioner has challenged the order dated 7th February, 2019 by which the learned trial Judge has adjourned hearing of the suit to 25th March, 2019. 3.

Mr. Shah has invited my attention to the application dated 13th February, 2019 made by the petitioner in the trial Court, inter alia, contending the he is 68 years old. He has come from U.S.A for recording the evidence. He has booked return ticket for 25th March, 2019 to U.S.A. The petitioner has, therefore, prayed for completing recording of his cross-examination before 20th March, 2019.

In view thereof, the learned trial Judge is requested to dispose of the application dated 13th February, 2019 made by the petitioner for completing cross-examination before 24th March, 2019, within one week from today. Subject to this, Petition is disposed of. Order accordingly. [R.G. KETKAR, J.]
