Heard the learned counsel for the parties.

Mr. Patil, the learned counsel for the appellant, on instructions, states that dispute has been amicably settled between the parties and on the basis of Consent Terms filed, the regular execution case No.54/2011 pending on the file of Civil Judge, Senior Division at Islampur has been disposed of on 13/8/2020. The learned counsel has tendered a certified copy of the Consent Terms alongwith the order passed on it, which is taken on record and Mamta Kale page 1 of 2

4-sa-123-14 marked 'X' for identification. The learned counsel points out that one of the terms of the compromise, is that the appellant shall withdraw the second appeal.

The learned counsel, therefore, on instructions, seeks leave to withdraw the appeal. In the result, the second appeal is dismissed, as withdrawn, with no order as to costs. The appellant shall be entitled to refund of Court Fees, as per rules. 4.

A decree be drawn accordingly.
