Pending the Appeal, the parties have arrived at Settlement and accordingly tendered Consent Terms dated 26 August 2015. The same is taken on record and marked "X" for identification purposes.

dgm 2 There is no objection with regard to the authorisation as well as verification of respective parties. It is signed by the parties and their respective Advocates.

The statement is also made that the above consent terms will not affect the third person or party. It is a private lis between the parties.

All the parties who signed the consent terms are present in Court today. Their respective Advocates have identified them. The undertaking so mentioned in the consent terms as accepted by the parties, therefore, the Court is recording the same as accepted.

The present First appeal is, therefore, disposed of in terms of Consent Terms dated 26.08.2015.

In view of disposal of First Appeal, Civil Application No. 728/2013 and Civil Application No.584 of 2015 stand disposed accordingly.
