At the outset learned APP makes a statement on instructions that the charge-sheet will be filed within four days from today. Statement is recorded and accepted. 2.

In this background, learned Counsel for the applicant makes following prayers on instructions:- (i) The application be allowed to be withdrawn with liberty to the applicant to approach the trial Court for his release on bail in the changed circumstances of filing of the charge-sheet.

(iii) Applicant'

s health condition is not good and therefore, special care may be provided to him. 3.

Request made by learned Counsel for the applicant is reasonable. The application is allowed to be withdrawn with liberty to the applicant to approach the trial Court for his release on bail in the changed circumstances of filing of the charge-sheet. If such bail application is filed, the trial Court is directed to decide the application expeditiously. Considering the health condition of the applicant, if in the meantime, the applicant is in urgent need of medical treatment, necessary facilities be provided to him on urgent basis.
