By this Civil Application Applicant original Claimant is seeking withdrawal of the amount deposited by the Respondent before the Trial Court.

The learned counsel for the Applicant submits that as per order dated 28.02.2007 passed by this court hearing of First Appeal is expedited. He submits that First Appeal be Mohite 1/2

8 caf809-16.doc placed on board for final hearing. He submits that at present, he is not pressing the present Civil Application.

In view of these facts, the learned counsel for the Applicant submits that he may be permitted to withdraw the Civil Application.

To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted.

Civil Application stands disposed of as withdrawn.

Registry is directed to place First Appeal No.618 of 2007 for final hearing in weekly board as per its turn.
