IN THE HIGH COURT OF JUDICATURE AT BOMBAY

KANCHAN VINOD MAYEKAR KANCHAN VINOD MAYEKAR Date: 2022.06.08 10:56:54 +0530 CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 2827 OF 2022 Arjun Girijappa Chinchawale ..... Petitioner

VERSUS

Pune Municipal Corporation ..... Respondent Mr.S.C.Wakankar for the Petitioner.

Mr.Rajdeep S.Khadapkar for the Respondent.

CORAM : ROHIT B.DEO, J.

DATE : 6TH JUNE, 2022 P.C:- The grievance of the petitioner is that the application Ex.12 in the Regular Civil Appeal filed on 2021 which is preferred challenging the demand under the Maharashtra Municipal Corporation Act, is not being decided expeditiously.

2.

Perusal of the application Ex.12 reveals that the prayer is that the status quo be granted. The grievance appears to be that instead of considering the said application with the urgency, which is enquired, the hearing is simply adjourned.

KVM 2/2 30 - WP 2827 OF 2022.doc 3.

I have heard learned counsel for the petitioner and the learned counsel for the respondent.

4.

Considering that the application seeking status quo is pending since 2nd February, 2022, it would be appropriate to dispose of the petition by directing the learned Appellate Court to decide the application Ex.12 within four weeks.

5.

The petitioner shall produce copy of this order on the next date of hearing in the Appellate Court.

6.

Writ petition is partly allowed and is disposed of. [ROHIT B.DEO, J.]
