This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 285 of 2022 registered at Uran Police Station, Raigad for the offences punishable under Sections 307, 504, 506 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on the date of incident which took place on 9 October 2022, the dispute arose between the complainant Kanchan P Dhuri 1 / 2

71-BA-544-2023.odt and the present applicant on account of some trivial issue. It is alleged that on account of the said dispute, the present applicant assaulted the complainant by some sharp weapon on his neck and attempted to kill him. 5.

The applicant is in jail for about six months. There are no other criminal antecedents. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Rupesh Lalan Prasad be released on bail in Crime No. 285 of 2022 registered at Uran Police Station, Raigad for the offences punishable under Sections 307, 504, 506 r/w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
