Learned Counsel submits that the appellant has also filed an application for setting aside the order dated 20/08/2014 before the District Court, Raigad, Alibaug and that matter is listed for final hearing on 27/03/2020. In this view of the matter, she seeks leave to withdraw the present appeal with liberty to pursue the application filed before the District Court.

First Appeal is allowed to be withdrawn. It is made clear that I have not gone into the merits of the matter and learned Judge is free to decide the application for setting aside order dated 20/08/2014 on its own merit.

In view of withdrawal of the First Appeal, pending Civil Application/ Interim Application will not survive and the same shall stand disposed of accordingly.
