Civil Application No. 4080 of 2015 The Appeal is filed against the order dated 20th August, 2014 in a custody matter under which the appellant/father is directed to handover the custody of minor girl child to the respondent/mother. 2.

This Application is moved by the applicant, as there is a delay of 87 days in filing the First Appeal.

The learned counsel for the respondent is present. 3.

In view of reasons mentioned in the Application, a case is made out 1 / 3

for condonation of delay. Hence, the delay is condoned. Civil Application is allowed.

Appeal be registered.

Civil Application No. 4081 of 2015 6.

This Application is moved for custody, pending appeal, to be given to the applicant/father.

Today, the father and mother both are present. After discussion through their counsel, they made a statement before the Court that child Annaya will be brought by the mother in the Court of Civil Judge Junior Judge, Belapur on 19th December, 2015, as there is a Court date in Belapur Court for the maintenance of the child. The father will pick up the child from Belapur Court at 4 p.m. and the child will stay with the father on that day and will be dropped by the father at the mother's residence on 20th December, 2015 at 6 p.m. The access entirely depends on the willingness of the child.

However, it is further agreed between the parties that if the child is ready to stay with the father, she may continue to stay till 22nd December, 2015, however, the mother informs that on 21st and 22nd December, 2015 2 / 3

the child is having school. So, the father will have to take the responsibility to drop the child to school and bring her back. The child will be dropped back at her mother's residence on 22nd December, 2015 directly from the school.
