P.C.:

1) The applicant is seeking bail in CR No.I-133 of 2015 registered with Shrinagar Police Station, Thane city.

2) The learned APP at the outset submitted that the investigation pertaining to the present crime is culminated into Sessions Case No.378 of 2015. The learned APP on instructions submitted that the trial pertaining to Sessions Case No.378 of 2015 has already commenced and seven witnesses have already been examined and there are two more witnesses to be examined. She on instructions further submitted that the present applicant committed the present crime when he was on bail in an earlier crime.

3) In view of the above, the learned counsel for the applicant on instructions seeks leave to withdraw the present application and prayed that the trial pertaining to Sessions Case No.378 of 2015 be expedited. Leave granted.

Dond 2/2 ba.331-2016.sxw 4) In view of the fact that only two witnesses remained to be examined by the prosecution, the learned Additional Sessions Judge seized of Sessions Case No.378 of 2015 is hereby requested to make an endevour to expidite the trial and conclude the same within a period of six months from today. 5) Application is disposed off in the aforesaid terms.
