CORAM :
NITIN JAMDAR AND N.R. BORKAR, JJ.
DATED :
26 AUGUST 2022 P.C. :- Heard the learned Counsel for the Petitioner. 2.
The learned Counsel for the Petitioner is appointed through legal aid. A letter written by the Petitioner is placed alongwith the orders passed by the jail authorities. There is no chronology of page numbers and what we understand from the oral arguments and the papers placed before us is that the orders are passed rejecting the furlough leave on the ground of unsatisfactory surety provided and adverse police report. The Petitioner has made a fresh application on 5 August 2022, which is pending.
3.
In the order dated 12 August 2022 passed in Criminal Writ Petition No. 204 of 2022, this Court after taking note of two circulars MJ Jadhav 1 / 2
45-wp-1235-20.odt issued by the Police and Prison Authority dated 10 August 2022 and 11 August 2022 has directed reconsideration of the applications. The learned APP states that fresh application dated 5 August 2022 filed by the Petitioner would be considered as per these Government Resolutions and as per the order dated 12 August 2022. 4.
In light of this position nothing further survives in this Petition and the same is disposed of.
5.
Registry to send a copy of the order to the Secretary of Maharashtra Legal Services Authority to look into the issue as we find in many cases a proper petition is not filed by the appointed Advocates.
