The Applicant wife filed the above Misc. Civil Application under Section 24 of the Code of Civil Procedure, 1908 seeking transfer of Petition No. A-3062 of 2016 filed by the Respondent-husband and pending before the Family Court, Bandra, Mumbai to the Civil Judge, Senior Division, Karad, Dist. Satara. 2.

The Respondent is present in Court. He has handed over his submission to this Court wherein he has inter alia stated that he has no objection if Petition No. A3062 of 2016 filed by him before the Family Court, Bandra, Mumbai is transferred to the Court of Civil Judge, Senior Division, Karad, Dist. Satara. Since his Application is in English, this Court enquired from him in Marathi whether he has any objection if Petition No. A-3062 of 2016 is transferred from Family Court, Bandra, Mumbai to the Court of Civil Judge, Senior Division, Karad, Dist. Satara. He has informed the

i.

Petition No. A-3062 of 2016 filed by the Respondent before the Family Court, Bandra, Mumbai is transferred to the Court of Civil Judge, Senior Division, Karad, Dist. Satara.

ii.

The Family Court, Bandra, Mumbai shall on or before 15 th September, 2017 transmit the papers and proceedings in Petition No. A-3062 of 2016 filed by the Respondent to the Court of Civil Judge, Senior Division, Karad, Dist. Satara. iii.

Both the parties shall appear before the Civil Judge, Senior Division, Karad, Dist. Satara on 19 th September, 2017 at 11.00 a.m. and obtain appropriate orders. iv.

The Civil Judge, Senior Division, Karad, Dist. Satara shall endeavour to dispose of Petition No. A-3062 of 2016 within a period of six months from the date of receipt of the same.

v.

All contentions of the parties are kept open. vi.

The parties as well as the learned Principal Judge, Family Court, Bandra, Mumbai and the Civil Judge, Senior Division, Karad, Dist. Satara to act on an authenticated copy of this order.

vii.

The above Misc. Civil Application is allowed in the aforesaid terms, with no order as to costs.
