This C.R.A. takes exception to the judgment and order dated 15.07.2010 passed by the learned Civil Judge Junior Division, Pune below exhibit-47 in Special Civil Suit No.801 of 2008. Mr. Soni states that the applicant and the plaintiffs have settled the entire controversy. He has tendered draft consent terms between the plaintiffs and defendants, which is taken on record and marked 'X' for identification. He, therefore, states that applicant will withdraw this Application and file consent terms entered into between plaintiffs and defendants in the trial Court and invite the trial Court to pass decree in terms of the consent terms. He states that in case compromise decree is not passed, liberty may be reserved to the applicant to file application for revival of this C.R.A.

CRA565_15.sxw controversy is settled between him and the applicant. He has tendered photocopy of the identity card issued by the Election Commission of India. The same is taken on record and marked 'Y' for identification. 4.

In view thereof, on the motion made by Mr. Soni, Application is allowed to be withdrawn and is disposed of as withdrawn with liberty as prayed for.
