This is an Application under section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending her arrest in C.R.No.14/2023 registered with Sangola Police Station, Solapur Rural for offences punishable under sections 420, 406 r/w. 34 of the Indian Penal Code. 2.

Heard learned counsel for the Applicant, learned APP for the State and learned counsel for the Intervenor. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties.

The allegations against the Applicant are that she and her 1/2

P.H. Jayani 32(A) ABA494.2023.doc husband had induced the Complainant and other investors to invest money in Shubh Tradebiz India LLP. It is stated that the interest as assured was paid for some time and thereafter neither the interest was paid nor the principle amount was refunded.

The Applicant herein was not the Director of the said company. It appears that she is working as an agent and had also herself invested Rs.4,00,000/- in the said company. It appears that an amount of Rs.6,00,000/- was credited in the account of the Applicant. She has deposited the said amount before this Court.

Considering the fact that the Applicant was not the Director of the company and was working only as an agent and was also a victim of the said fraud, in my considered view, she is entitled for pre-arrest bail. Hence, the order dated 27/02/2023 stands confirmed. The Applicant is directed to report to the Investigating Officer as and when required.
