The above Petition was filed in view of the fact that the College Tribunal for Mumbai and Thane was not constituted. The Learned Counsel for the Petitioner seeks withdrawal of the above Petition in view of the fact that the College Tribunal has now been constituted and that the Petitioner intends to avail the remedy by way of an Appeal under Section 59 of the Maharashtra University Act. The Petition is accordingly allowed to be withdrawn with liberty to file an Appeal before the College Tribunal. Needless to state that if the question of limitation arises, the fact that the above Petition had to be filed in this Court would be considered by the College Tribunal.
