Heard learned Advocate for the Applicant and learned APP for the Respondent-State.
2. The present Applicant along with two others are chargesheeted for committing offence under Section 376, 420, 406, 417, 419 read with 34 of IPC and under Sections 66(c), 66(d) of the Information Technology Act.

Even though the criminal law was set in motion, when the victim lodged complaint with Vishnunagar police station, Dombivali on 16th April 2021, thereby evidencing about parting away money Shiv 1/2
22.ba679.22.doc and ornaments on the pretext of marriage and having sexual intercourse with the victim, there were three more victims. Even they have parted away money. It is true that certain ornaments and money is seized and attached.

After considering these materials, when I was not inclined to grant bail, learned Advocate for the Applicant seeks leave to withdraw this Application with liberty to file fresh Bail Application, if there is no progress in the trial. Hence, the following order is passed:
ORDER
(a) Application is disposed of as withdrawn.
(b) Liberty is granted to the Applicant to apply afresh for bail, if there is no much progress in conducting trial within one year from today.
(c) Let copy of this order be forwarded to the concerned Court. [S. M. MODAK, J.] Shiv 2/2
