Heard the learned advocate for the applicant and learned APP for the State.

Respondent No. 2 is absent though he is served. The applicant is directed to file affidavit-of-service in registry of this Court, before 5 O'clock today.

As far as prayer for grant of permission to travel 1/2

905)APPP175.15 abroad is concerned, I do not think that there should be any hesitation in granting the said prayer, inasmuch as, the applicant had been granted the similar prayer in the past also and he has not violated any conditions imposed by this Court. The applicant is staying at Vile Parle, Mumbai, wih his family. There is no apprehension that he will flee from the country and will not face trial, hence I pass the following order:

The applicant is permitted to travel abroad during the period between 28th of February, 2015 till 31st of May, 2015. The passport shall be returned to him by the Metropolitan Magistrate, 10th Court, Andheri, Mumbai. The passport shall be deposited in the Court by the applicant immediately after his return from abroad.

The application stands disposed.
