The learned APP has placed on record a copy of the report dated 22nd February 2017 submitted by the Senior Inspector of Police of Economic Offences Wing and In-charge Assistant Commissioner of Police, Economic Cyber Offences, Pune City. In the said report, he has stated that after carrying out investigation, it was found that there was no evidence available against the Applicant for filing chargesheet. Therefore, a prayer has been made for

sng APL-174.15 deleting the name of the Applicant as an Accused by invoking Section 169 of the Code of Criminal Procedure, 1973.

In view of the statements made by the Investigating Officer in the said report, as of today, it is not necessary to entertain this Application for quashing the First Information Report.

If the report submitted by the Senior Inspector of Police is not accepted by the learned Magistrate, it will be open for the Applicant to file a fresh Petition in this Court for the same relief.

Subject to what is observed above, the Application is disposed of.
