The Applicants are challenging the charge-sheet in Criminal Case No.263/PW/2022 pending before the Court of learned Metropolitan Magistrate 29th Court, Dadar, Mumbai. 2.

The First Information Report (for short 'FIR') was registered with Wadala T.T. Police Station vide C.R. No.148 of 2019 by SUNNY ANKUSHRAO THOTE Date:

2024.04.22 19:20:03 +0530 SUNNY ANKUSHRAO THOTE on 15th May, 2019 for offences under Sections 498-A, 406, 323, 504 r/w 34 of Indian Penal Code (for short 'IPC').

FIR was lodged by the Respondent No.1. The Petitioner No.1 is the husband, Petitioner No.2 is the mother-in-law, Petitioner No.3 is the sister-in-law, Petitioner Nos.4 to 6 are brother-in-law of Respondent No.1.

The parties have resolved the dispute. The complainant has no objection for quashing the impugned proceedings. Divorce Petition is pending before the Family Court at Bandra. Consent terms are executed. It is agreed that the Petitioner No.1 would provide permanent alimony of Rs.8,00,000/- to the complainant and amount of Rs.4,50,000/- has been paid to the complainant and the balance amount would be parted to the complainant after that decree of divorce by mutual consent is passed. 5.

The complainant is present in Court. She is represented and identified by the Advocate. She has filed affidavit of consent. She has no objection for quashing the impugned proceedings. 6.

In view of settlement between the parties and considering the cause of the dispute between the parties which has been resolved, the impugned proceedings can be quashed.

ORDER

i.

Criminal Application No.228 of 2024 is allowed; ii.

The proceedings in Criminal Case No.263/PW/2022 pending before the Court of learned Metropolitan Magistrate 29th Court, Dadar, Mumbai arising out of FIR No.148 of 2019 on 15th May, 2019 registered with Wadala T.T. Police Station are quashed and set aside.

iii.

Application stands disposed off.
