The parties agree that the issue arising in the present petition is identical to the issue involved in Writ Petition No. 3150 of 2014, and therefore, the decision in Writ Petition No. 3150 of 2014 shall govern disposal of the present petition also. In such circumstances, for the reasons mentioned in the judgment and order dated 14th January, 2020 in Writ Petition No. 3150 of 2014, following order is passed:

ORDER

(i) Writ petition is allowed and the impugned judgment and order is hereby set aside.

WP. 3112-14 (ii) Dispute Application No. 459 of 1993 is hereby restored on the file of Co-operative Court at Satara for disposal according to law. (iii) Rule is made absolute in the aforesaid terms with no order as to costs.
