This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 106 of 2022 registered at Shrivardhan Police Station, Raigad for the offences punishable under Sections 353, 307, 332, 504, 506 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The allegations against the present applicant are that on 20 August 2022 the present applicant assaulted the police personnel, who Kanchan P Dhuri 1 / 2

924-BA-553-2023.odt went to her house to arrest her as she was staying at her house in breach of externment order.

I have perused the injury certificate. The injuries are simple. The learned APP submits that there are criminal antecedents. However, it appears that applicant is in jail for seven months. Considering this fact, I am inclined to release the applicant on bail on certain conditions. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Nagma Shabbir Kesarkar be released on bail in Crime No. 106 of 2022 registered at Shrivardhan Police Station, Raigad for the offences punishable under Sections 353, 307, 332, 504, 506 r/w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount. (iii) The applicant shall not enter into the limits of Shrivardhan Taluka till conclusion of trial except to attend the dates before the trial Court.

(iv) The applicant shall furnish residential address where she is going to reside after her release and mobile number, if any, to the concerned police station.
