1) This is an application for modification of condition imposed upon the applicant while releasing him on bail by the leaned Additional Chief Metropolitan Magistrate 19th Court, Esplanade, Mumbai by its order dated 19.1.2012. By the said order the applicant was directed not to leave India without the prior permission of the said Court. 2) The learned counsel for the applicant submitted that the applicant is a businessman and is required to travel abroad frequently. He submitted that many a times the applicant has to go to abroad at last minute for the business purpose and it is difficult for him to get the permission from the concerned Court in short time. He therefore, submitted that the said condition may be waived. 3) Mrs. Gonsalvez, the learned Special PP appearing for
2 /2Appln-524-16-912 the CBI on instructions submitted that, CBI does not have any serious objection for modifying the said condition if the applicant is directed to intimate the CBI EOW, Mumbai at least a week in advance his itinerary.
4) In view thereof, the condition not to leave India without prior permission of the said Court imposed upon the applicant by an order dated 19.1.2012 by the Additional Chief Metropolitan Magistrate, Mumbai is hereby modified and the applicant is permitted to leave India after giving prior intimation at least one week in advance to the CBI, EOW, Mumbai. The other condition Nos.2 to 6 imposed upon the applicant by an order dated 17.2.2012 by the said Court are maintained and are not disturbed.
