The learned counsel for respondent No.1-bank states that the recovery proceedings against the petitioner are concluded and the entire loan amount has been recovered. He submits that the secured asset was sold and the balance amount has been returned to the petitioner. He therefore submits that nothing survives in the petition, which raises a challenge to the order passed by the Metropolitan Magistrate. The petition is dismissed for want of prosecution, with no order as to costs.
