By this Civil Application, Applicant is seeking deletion of the name of Respondent No. 2 Madhavi Kisan Bhatkar from the cause title of First Appeal No. 1060 of 2013 and pending application. 3.

Considering the submission made by the learned counsel for the Applicant, averments made in Civil Application, I am satisfied that the Applicant has made out the case for allowing the Civil Application. 4.

Hence, the following order:

Civil Application allowed in terms of prayer clause (a) which read thus:

"a.

That the Respondent No.2 be deleted from the above First Appeal No. 1060 of 2013 and permission to carry out necessary amendment by deleting Respondent No. 2 from the said First Appeal."

b.

The Applicant to carry out appropriate amendment in First Appeal and pending Civil Application on or before 5th July, 2019 and serve amended copy of the First Appeal to other side. c.
