Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which reads thus:

"a)The applicant be permitted to serve the Respondent No.1 through substituted service by publication in two local News Papers circulated in the city of Mumbai viz (i) The Indian Express (in English) and (ii) Navbharat Times (in Hindi), and thereafter the matter may be listed for final hearing."
