IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION No. 2095 OF 2015 Mrs. Kalpana Vishwanath Singh & Anr.

...

Petitioners Vs.

Kotak Mahindra Bank Ltd.

...

Respondent *** Mr. Pradeep Havnur a/w Ms. Najafia Shroff, for the Petitioners. Mr. Sanjay Anbhawane, for Respondent.

*** CORAM : V. M. KANADE, & A. R. JOSHI, JJ.

DATE : MARCH 2, 2015 PC.

1.

Heard the learned counsel appearing on behalf of the Petitioners and the counsel appearing on behalf of the Respondent. Petitioners are aggrieved by the impugned order dated 9.2.2015 passed by the DRAT, directing the Petitioners herein to deposit Rs. 50 lakhs in two equal instalments. We have perused the impugned order. In paragraph 4 of the said order, the DRAT has observed that the counsel for the Appellants (petitioners herein) made a statement that Appellants were ready to pay Rs. 50 lakhs.

2.

Since the Appellants have given consent to deposit Rs. 50 1 / 2

WP. 2095-15 lakhs, the impugned order has been passed. We do not think that this is a fit case for interfering with the impugned order. If the Petitioners are aggrieved by the observations made in paragraph 4, he may approach the DRAT for clarification and / or modification of the impugned order. With this direction, writ petition is disposed of. Sd/- Sd/- [A. R. JOSHI, J.] [V. M. KANADE, J.] Vinayak Halemath 2 / 2
