After arguing for sometime, when the Court was not inclined to entertain the petition, having regard to the order dated 16th February, 2022, passed by this Court (Coram : G. S. Patel & Madhav J. Jamdar, JJ) in Writ Petition (L) No. 1961 of 2022, learned Counsel for the petitioners sought leave to withdraw the aforesaid petition. The order dated 16th February, 2022 reads as under;

"1.

On instructions, Mr. Morris seeks leave to withdraw the Wakodikar 1/2

16. WP 4563-2022.doc petition. The petition is dismissed as unconditionally withdrawn.

However, all contentions are kept open for appropriate arbitration proceedings.

Previous order dated 27th January, 2022 stands vacated. 4.

All concerned will act on production of a digitally signed copy of this order."

The petition is accordingly dismissed as withdrawn. 3.

Despite the order dated 16th February, 2022, the aforesaid petition has been filed and hence, in the peculiar facts, it would be appropriate to direct the petitioners to pay costs. Accordingly, the petitioners to deposit Rs.1,00,000/- with the Kirtikar Law Library. 4.
