During the course of investigation it is revealed that after the applicant's TIN was ceased to be in operation, the co-accused has used the same thereby claiming benefit of the taxes from the government authorities. The learned Spl.P.P on instruction from Mr. Ganesh Pisal, Investigating Officer submitted that the custodial interrogation of the applicant is not necessary as of now the real perpetrator of the said crime is revealed.

In view of the above the applicant is granted pre-arrest bail. Hence, the following order :

(a) In the event of arrest of the applicant in CR No.223/2014 registered with Borivali (W) Police Station, Mumbai he shall be released on bail on his furnishing a P.R. bond of Rs. 25,000/- with one or two local sureties in

(b) The applicant shall attend the Investigating Officer as and when called for the purpose of investigation between 11.00 a.m. to 4.00 p.m. till the filing of the charge sheet. It is needless to mention that before calling the applicant to the Police Station, the Investigating Officer shall issue notice under section 160 of Cr.P.C.

(c) The applicant shall furnish his mobile number and or residential address to the Investigating Officer for his contact.

(d) The applicant shall not tamper with the evidence and/or influence the witnesses;
