Learned Counsel for the petitioner makes a statement that he will not press the reliefs claimed in the above petition provided hearing of this application filed in Civil Appeal No.136 of 2006 pending before the Addl. District Judge at Kalyan under the provisions of Section 193, 199, 200, 205 IPC is expedited. Counsel for the respondent no.2 has no objection for expeditious hearing of the said applicatin.

In the above circumstances, this petition is disposed of by passing the following order:
ORDER
i) Learned Addl. District Judge at Kalyan is directed to expedite and dispose of the petitioners application dated 12.8.2013 under Section 193, 199, 200, 205 IPC in Civil Appeal No.136 of 2006, immediately and preferably within period of six months from the date of receipt of this order.
ii) Needless to mention that we have not gone through the merits of the said application and the learned Addl. Sessions Judge, Kalyan shall disposed of the same after hearing all concerned independently on its own merits.
iii) All points and contentions of the respective parties are expressly kept open.
