Though respondent nos.1 and 2 are duly served, no one appeared on behalf of them when the matter was called out.
This application is preferred by Insurance Company for condonation of 127 days delay in filing First Appeal challenging the judgment and award dated 1.7.2013 passed by MACT, Pune in MACP No.443 of 2010.
Considering the submissions made by the learned counsel for the Applicant and the Mohite 1/2
29 caf248-15.doc averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
A) Civil Application is allowed in terms of prayer clause (a) which read thus:
"(a) That the delay of 127 days in filing the present First Appeal be kindly condoned and the accompanying First Appeal be registered and heard for admission."
B) Civil application stands disposed off accordingly.
