Heard learned counsel for the applicant and learned APP for the State.

This is an application for suspension of sentence and bail. The trial Court by the impugned judgment and order convicted the applicant for the offence punishable under Section 353 of the Indian Penal Code and sentenced him to suffer simple imprisonment for two years. The applicant during the pendency of the trial was in custody for 14 days. The appeal is unlikely to be heard soon.

The application for suspension of sentence and bail is opposed by learned APP.

The applicant was on bail during the trial. There is nothing on record to indicate that the applicant has misused his liberty while on bail. Considering the short sentence and as the appeal is not likely to be heard any time soon in near future, I am inclined to suspend the sentence and enlarge the applicant on bail. Hence, the following order :-

O R D E R

(a) The sentence is suspended.

(b) The applicant-Ramdas Dadabhau Dherange shall be released on bail on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the trial Court once in a year, i.e. first Monday of the concerned month, between 11.00 a.m. and 1.00 p.m. commencing March 2024.

(d) On being released on bail, the applicant shall furnish his contact number and residential address to the Trial Court as well as the Investigating Officer and shall keep them updated, in case there is any change. 2/3

The interim application is disposed of in the above terms.
