It is the case of the petitioner that he is a retired Government Servant and presently is in receipt of pension of Rs.15,000/- per month. The wife has fled an application under Section 125 of the Criminal Procedure Code, 1973 seeking maintenance on the ground that she has been left as a destitute, not looked after by her husband or her own children. 2.

The learned Judge, Family Court, Nashik, by taking into consideration the amount of pension received by the husband and the fact that without any source of income for the applicant/wife, an amount of Rs.4,000/- would be suffcient for her bare M.M.Salgaonkar

The learned Judge, Family Court, Nashik has taken into account the balancing factors required to be looked into while granting the maintenance which would prevent the woman from being left as a destitute or with a matching responsibility of husband to take care of his wife and not to neglect her.

The impugned order do not call for any interference and stands affrmed.

The writ petition is disposed of 5.
