IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION IN APPEAL NO.260 OF 2018 IN CRIMINAL APPEAL NO.1167 OF 2015 Atul Chandrakant Pawar : Applicant/Appellant.

Versus

The State of Maharashtra : Respondent.

Ms. Pranali Kakade I/by Hulyalkar & Associates for the Applicant. Ms. P P Shinde, APP for the Respondent/State. CORAM :

A.S.OKA & A.S.GADKARI, JJ DATE :

21st January 2019 P.C.

Heard the learned counsel appearing for the Applicant. The earlier application made by the Applicant for release on bail has been rejected by the Division Bench of this Court by an order dated 10th February 2016. The only change in circumstance is the alleged passage of time.

Considering the observations of the Division Bench in the order dated 10th February 2016 we find that this is not a case where only on the ground of passage of time that a case of change in circumstance is made out requiring this Court to change the view taken earlier. The Criminal Application is accordingly rejected.
