By this application, the applicants seek pre-arrest bail in connection with C.R. No. 89 of 2018 registered with the B.K.C Police Station, Mumbai, for the alleged offences punishable under Sections 406, 409, 420, 120B of the Indian Penal Code.

Learned counsel for the parties have tendered the Consent Terms entered into by and between the applicant Nos. 2 and 3 and the 1/3

complainant i.e. respondent No. 2. A copy of the said Consent Terms is taken on record and marked `X' for identification. It was informed on the last date that applicant No. 1-Sudhir K. Singh is arrested and is presently in custody.

Pursuant to the said Consent Terms, the parties have settled their dispute for an amount of Rupees Three Crores. The details of payment made by the said applicants to the complainant, are set out in clause (a) of the said Consent Terms.

Without going into the merits, having regard to the fact that the parties have amicably settled the dispute, the application is allowed and the applicant Nos. 2 and 3 are granted pre-arrest bail on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicant No.2-Rakhee Singh and applicant No. 3-Aditya Singh be enlarged on bail on executing P.R. Bond in the sum of Rs.20,000/- each, with one or two sureties in the like amount;

(ii) The applicant Nos. 2 and 3 to abide by the Consent Terms entered into by and between them and the complainant. The application is accordingly disposed of.
