This application is for bringing legal heirs on record of deceased Appellant No.1 Shri Pandarinath Bhikaji Khokarale who died on 06/01/2006.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clauses (a) to (c) which read thus:

a) That the delay in filing this Civil Application be kindly condoned.

b) That the abatement of above Second Appeal if any be kindly set aside.

c) That the names of the Applicant Nos.1A to 1E be kindly brought on record as heirs and legal representatives of Appellant No.1 Shri Pandarinath Bhikaji Khokarale by making necessary changes in title of above Second Appeal.

b) The Applicant to carry out appropriate amendment within 6 weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

c) If amendment is carried out within stipulated time as stated hereinabove, the Applicant is directed to serve an amended copy of the Second Appeal on the Respondent or their Advocate, immediately.

d) Civil application stands disposed off accordingly.
