This Petition has been filed under section 11 of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator. Learned Counsel for the parties are agreeable to the appointment of a sole Arbitrator. Learned Counsel for the Respondent has suggested the name of Mr. Justice M.G. Gaikwad, a former Judge of this Court. Learned Counsel for the Petitioner states that the Petitioner is not agreeable to the name suggested by the Respondent. Learned Counsel for the parties however state that they leave it to the Court to nominate and appoint the sole Arbitrator. In the circumstances, the following order is passed: 1/2

Thakkar, former Judge of the Supreme Court, residing at D-64, Akash Tower, Judge's Bungalow Road, Bodakdev, Ahmedabad 380 054, is appointed as the sole Arbitrator to adjudicate the disputes and differences between the parties under the Arbitration and Conciliation Act, 1996. ii) Registry to communicate this order to Mr. Justice C.K. Thakkar, together with a memorandum of address of the parties. iii) All contentions before the learned Arbitrator are kept open. The Arbitration Petition is disposed of in aforesaid terms. (A.A.
