1/3
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.2302 OF 2015 IN REVIEW PETITION NO. OF 2015 IN WRIT PETITION NO.9413 OF 2004 Shri. Rangrao Gulabrao Jagdale ....
Applicant Vs.
Shri. Dilip Gulabrao Jagdale ....
Respondent Mr. R.V. Bansode, Advocate for the Applicant. Coram : Smt. R.P. SondurBaldota, J.
Date : 11th September, 2015 P.C.
This Civil Application is for condonation of delay of 213 days in filing petition to seek review of the order dtd. 26th June, 2014 passed in Writ Petition No.9413 of 2004 filed by the respondent. At paragraph 3 of the application, the applicant refers to communication gap between him and his advocate and alleges that the order dtd. 26th June, 2014 was not immediately communicated to him by the advocate. He then claims to have "recently asked" the status of the matter with his advocate on record and learnt about the dismissal of the writ petition on 26th June, 2014. It is further stated by
2/3 him that he received authenticated copy of the order on 6th February, 2015. The present application alongwith the review petition was filed on 20th February, 2015.
The explanation stated in the application for the delay is absolutely vague and without any particulars whatsoever. It is as good as no explanation. Hence, the Civil Application is dismissed. In view of the dismissal of the Civil Application, the Review Petition filed does not survive. The same is accordingly disposed off.
